This Privacy Policy explains how we collect, use, disclose, and protect your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. This policy applies to personal information we collect about our members, suppliers, and staff.

2 Collection of Personal Information

2.1 When we collect

We may collect personal information from you in various ways, including but not limited to when you:

  1. register as a member;
  2. visit our club;
  3. contact us via phone, email, or through our website, including membership and promotional enquiries;
  4. participate in our fitness programs or events;
  5. provide us with information from third parties such as doctors, physiotherapists, or other health professionals or allow us to collect that information from those professionals with your consent;
  6. apply for a job or become a member of our staff;
  7. provide services as a supplier;

The types of personal information we collect may include but is not limited to:

  1. name;
  2. date of birth;
  3. contact details (email, phone number, address);
  4. health and fitness information;
  5. payment details;
  6. attendance records;
  7. emergency contact information;
  8. work history and qualifications (for staff);
  9. business details and financial information (for suppliers);

2.3 Collection of Sensitive Information

We may collect sensitive information, which includes health information, only with your consent or when required by law. Sensitive information may include:

For staff, sensitive information may also include:

With your consent, we may collect personal information about you from third parties, including but not limited to:

  2. physiotherapists and chiropractors;
  3. other health professionals;
  4. previous employers and referees (for staff); and
  5. business references (for suppliers).

This information is used to tailor our services to better meet your fitness and health needs, to manage employment relationships, and to manage supplier relationships.

2.5 Collection of Emergency contact information

If you provide us with personal information about an emergency contact person, you must have their consent to do so. The emergency contact information will be used solely for emergency purposes.

3.1 What we use personal information for:

We use your personal information for purposes including but not limited to:

  1. providing you with our gym and fitness services;
  2. processing your membership and payments;
  3. communicating with you about your membership, programs, and events;
  4. ensuring the safety and security of our members and staff;

  6. complying with legal and regulatory requirements;
  7. managing personal relationships and personnel benefits;
  8. managing supplier relationships and payments;

3.2 Marketing communications

With your consent, we may use your personal information to send you marketing and promotional materials about our services, special offers, and events. You can unsubscribe from these communications at any time by following the unsubscribe link included in the email or by contacting us directly via lanecove@fit.com.au.

Any personal information you provide to FIT, including but not limited to your name, mobile number and email, may be used by us to send you marketing and other communications about our Club and Services; you can opt-out or unsubscribe from these at any time by using the link provided with the message.

4 Disclosure of Personal Information  

4.1 Who we disclose personal information to

We may disclose your personal information to:

  1. our related companies;
  2. our staff and contractors to facilitate the delivery of our services;
  3. third-party service providers (such as payment processors and IT service providers) who assist us in delivering our services to your or in administering our personnel systems;
  4. health professionals, with your consent, to support your fitness and health goals;
  5. our professional advisers such as lawyers and accountants;
  6. legal and regulatory bodies as required by law;
  7. other personnel and management for employment-related purposes;
  8. relevant parties for supplier management and payment processing;

4.2 Disclosure for other purposes

We will not use or disclose your personal information for any other purposes or to any other persons without consent, unless such use or disclosure would be reasonably expected, required by law or is necessary to protect our rights or property or the rights or property of any of our related companies, contractors or suppliers or any member of the public, or to lessen a serious threat to a person's health or safety.

5 Security of Personal Information  

5.1 Reasonable steps to protect personal information

We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorized access, modification, or disclosure. These steps include secure storage, encryption, and access controls.

5.2 Storage and access

Personal information is stored on secure servers if in digital format, or in locked areas if in hardcopy format. These facilities are in Australia and may also be located overseas through our customer relationship management software known as GymMaster. If you become a Member, we will collect and process your Personal Information through GymMaster. A copy of GymMaster’s privacy policy is available at https://www.gymmaster.com/privacy-policy/. You should read this policy carefully and ensure that you are happy with it. If you do not accept GymMaster’s privacy policy, we will not be able to provide you with Membership. When you enter into a Membership Agreement with us, you acknowledge and accept GymMaster’s privacy policy.

A copy of your Personal information may be accessed by our personnel and third party service providers located in Australia and the Philippines. Our employees, contractors and third party service providers are obliged to respect the confidentiality of any personal and/or sensitive information held or accessed by them. We only permit authorised personnel and third party service providers to access your personal information and they are obliged to keep your information secure and comply with this Privacy Policy when they access your information.

5.3 Password security

You are responsible for keeping your FIT account username and passwords secure. Do not share your passwords with anyone. If you believe your password has been compromised, please change it immediately and notify us of any potential breach of your account.

5.4 Deletion and de-identification

We destroy or de-identify personal information we no longer need, wherever possible.

6 Direct Debit Information  

If you become a Member, you are required to set up a Direct Debit Request for payment of our Fees. You can use a credit card or a bank account for your Direct Debit arrangement. If you elect to use a credit card, your Personal Information will be disclosed to our third party provider, EziDebit, and if you elect to use a bank account, your Personal Information will also be disclosed to our third party provider, EziDebit. A copy of EziDebit’s privacy statement is available at https://www.ezidebit.com/en-au/privacy-statement and a copy of EziDebits’ Direct Debit Request Service Agreement is available at https://static.ezidebit.com.au/ServiceAgreement/AU/DDR_Service_Agreement.html. You should read the relevant policy carefully and ensure that you are happy with it. If you do not accept the privacy policies of our third party Direct Debit service provider, we will not be able to provide you with Membership. When you enter into a Membership Agreement with us, you acknowledge and accept the privacy policy of the Direct Debit service provider that offers the relevant credit card or bank account Direct Debit service.

You have the right to access the personal information we hold about you and to request corrections if you believe the information we hold is inaccurate, incomplete, or out-of-date. To make a request, please contact us using the details provided below.
